Terms and Conditions

Welcome to Exceptional Student Store.com. Users of products purchased directly from exceptionalstudentstore.com and Corazon del Oro Communications LLC (CDO) agree to the terms outlined below. Exceptional Student Store is a reseller of assistive technology products including software programs (“Products”) and is owned and operated by Corazon del Oro Communications LLC, a registered limited liability company in Tucson, Arizona. Please read the following terms and conditions carefully. When you purchase any Product from CDO, you are expressly agreeing to all of the following terms and conditions.

Limited Product Warranties and Licence Agreements

The following limited product warranties and license agreements apply to all software programs including: Tool Factory, Oxford Literacy Web, SEMERC, WYNN And TestTalker. Purchasers of all Software Programs agree to be bound by all license agreements with the manufacturers of these Software Programs. All purchasers of Products understand that CDO does not manufacture any of the Products. CDO does not make any representation or warranty whatsoever pertaining to the Products. As a reseller of the Products, CDO will assist purchasers in processing claims of defects covered by the manufacturers’ limited warranties set forth below.

Software Warranty

If you are not completely satisfied with the software, it may be returned within 30 days of your receipt of your order for a full refund. When you purchase the software from CDO, you agree to be bound by the license agreement and limited warranty provisions enclosed with each software CD. Some highlights of this agreement are listed below:

This warranty does not cover:

(1) Any software contained in the Products that have been subjected to damage or abuse by you.

(2) Any copy of the software that has been altered or changed in any way by you or by others.

(3) Any problems caused by the operating characteristics of your computer hardware or operating system.

The warranty cannot and does not guarantee that:

(4) The functions contained in any Software supplied to you will meet your
requirements .

(5) The operation of the Software will be uninterrupted, error or bug free.

(6) Third party software (including virus checkers and desktop control applications) will not interfere with the normal operation of any software provided to you.

(7) The software will work on customized networks, with user profiles or with restricted access to the operating system and files.

Acknowledgment of Non-Liability

By purchasing any Product from CDO, you acknowledge and agree that any material and/or software downloaded or otherwise obtained by you from CDO is used at your own discretion and your own risk. You agree that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material and/or software.

By purchasing any Product from CDO, you acknowledge and agree that CDO is not be liable to you or any other person for any loss or damage which may result from the use of the Products, including, without limitation:

(8) Damages for loss of business, loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and/or loss of data.

(9) Damage for loss which arises from your misuse of any of the information contained in the Products.

(10) Damages for loss due to business interruptions, loss of business information;

(11) Damages or loss due to viruses that may infect your computer equipment, software, data or other property on account of your installation, access, use, browsing and/or downloading of any material from the Products, or any websites accessed via the Products.

(12) Any other damages or loss which does not result directly from our wrongful actions .

By purchasing any Product from CDO, you acknowledge and agree that in any event, the maximum liability that CDO may have to you shall be limited to reimbursement of any amounts paid by you for the Products.

The license agreement shall not affect your statutory rights as a consumer.

Unishape Warranty

Unishape ™ Adaptive Equipment - Equipment is warrantied by its manufacturer (Unishape Adaptive Equipment, Inc. or “UAE”) against defects in materials and workmanship for a period of 2 years from the date of original purchase. If a defect arises and a valid claim is received by CDO within the warranty period, CDO will arrange for shipping to the manufacturer. The UAE warranty provides that they will:

(1) Repair of the product at no charge, using new or refurbished replacement parts; or

(2) Exchange of the product with a product that is new or which has been manufactured from new or serviceable used parts and is at least functionally equivalent to the original product; or

(3) Refund the purchase price of the product.

If a defect arises and a valid claim is received by CDO after the first one hundred and eighty (180) days of the Warranty Period, a shipping and handling charge will apply to any repair or exchange of the product undertaken by CDO. UAE warrants replacement products or parts provided under this warranty against defects in materials and workmanship from the date of the replacement or repair for ninety (90) days or for the remaining portion of the original product's warranty, whichever provides longer coverage for you. When a product or part is exchanged, any replacement item becomes your property and the replaced item becomes the manufacturer's property. When a refund is given, your product becomes UAE's property. This Limited Warranty applies only to the products manufactured by or for Unishape. This Limited Warranty does not apply to any non-UAE product, even if packaged or sold with the UAE product. Non-UAE manufacturers, suppliers, or publishers may provide a separate warranty for their own products packaged with the UAE product. UAE is not liable for any damage to or loss or any non-UAE product or part not covered by this warranty. This warranty does not apply to:

(a) Damage caused by accident, abuse, misuse, misapplication, or non-UAE products; or

(b) Damage caused by service performed by anyone other than UAE; or

If warranty service is needed, please contact CDO in writing at the address listed at the bottom of this page.

Use of UAE Products

The photographs and information contained in this web site is solely provided as an illustration of some of the possible uses of Unishape? equipment. It is by no means a guide for all individuals or uses. UAE and CDO STRONGLY RECOMMEND THAT ALL UNISHAPE? EQUIPMENT BE USED UNDER THE GUIDANCE OF A THERAPIST OR TRAINED PROFESSIONAL. THE PURCHASER ASSUMES ALL RISK OF INJURY OR PHYSICAL DAMAGE DUE TO THE USE OR MISUSE OF UNISHAPE? PRODUCTS AND CDO AND UAE ASSUME NO LIABILITY FOR ANY SUCH RISK OR DAMAGE. By purchasing any UAE product, you expressly agree that the use of the products described on this web site is at the user's own risk.

Product Descriptions

CDO attempts to be as accurate as possible in describing its Products. However, CDO does not warrant that Product descriptions or other content of this site is totally accurate, complete, reliable, current, or error-free. If a Product offered is not as described, your sole remedy is to return it in unused condition.

Severability

CDO reserves the right to make changes to this web site, and these Terms and Conditions at any time. If any of these Terms and Conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
